Terms of Use

Agreement
These Terms govern access to the GymPilot Systems software used by High Alpine Training Center. GymPilot Systems operates the app; the gym provides coaching and manages its own membership relationship. By accessing or using the service, you agree to these Terms, the Privacy Policy, and the Fitness & Nutrition Disclaimer. Separate membership agreements, waivers, payment terms, and gym rules also continue to apply.
Eligibility and accounts
Members must provide accurate information and use only their own account. Staff accounts may be used only for authorized gym work. Users must protect passwords, sign out of shared devices, and promptly report suspected unauthorized access. A member under 18 must have parent or guardian authorization. The service is not directed to children under 13.
Permitted use
The service is provided for gym coaching and member participation. Users may not access another person's account, scrape or copy private content, upload unlawful or harmful material, attempt to bypass security, disrupt the service, share confidential member information, or use GymPilot Systems programming or branding for an unauthorized commercial purpose.
Coaching information
Workout, nutrition, and progress information is educational fitness coaching, not medical care. Users must follow the Fitness & Nutrition Disclaimer, disclose relevant limitations to their trainer, use appropriate judgment, and stop activity that causes pain, dizziness, shortness of breath beyond normal exertion, or other concerning symptoms.
User content and photos
Users retain ownership of content and photos they submit. They grant GymPilot Systems a limited permission to host, copy, display, and process that content only as needed to provide, secure, back up, and administer the service. A member who starts Food Scanner directs GymPilot Systems to process the temporary meal image for the requested estimate. A member who scans a barcode directs GymPilot Systems to look up those digits through Open Food Facts. Saved and repeated meals remain part of the member's private nutrition history until removed or the account is deleted. Progress photos are governed by the Progress Photo Consent. Public, advertising, or social-media use requires a separate written release.
Fees and payment
Membership prices, refunds, cancellations, and payment obligations are governed by the member's separate gym membership or payment agreement. The app may display a payment status or link to an external payment provider but does not replace those agreements.
Availability and changes
GymPilot Systems may maintain, update, suspend, or discontinue features and may correct programming, scheduling, or data errors. Internet and hosting interruptions may occur. Users should not rely on the app for emergency communication.
Suspension and termination
GymPilot Systems may restrict or end access for security concerns, misuse, violation of these Terms, an inactive gym account, or the end of the gym coaching relationship. Provisions that reasonably should survive termination—including ownership, disclaimers, and limits of liability—will continue to apply.
Disclaimer and limitation
To the fullest extent permitted by law, the service is provided “as is” and “as available.” GymPilot Systems does not guarantee uninterrupted access, specific fitness or nutrition results, or that every plan is appropriate for every person. To the fullest extent permitted by law, GymPilot Systems is not liable for indirect, incidental, special, consequential, or punitive damages arising from use of the service. Nothing in these Terms limits rights or liability that cannot legally be limited.
Governing law
The gym membership agreement governs gym services. Applicable law governs use of this software and any dispute, subject to mandatory rights.
Changes and contact
GymPilot Systems may update these Terms and will post a new effective date. Continued use after notice of a material change indicates acceptance to the extent allowed by law. Questions: peakphysiquetransformations@gmail.com.
